Information on the right of withdrawal for consumers

Cancellation policy

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. To exercise your right of withdrawal, you must inform us (Kaffeekirsche Roastery, Tempelhofer Damm 160, 12099 Berlin, Germany, telephone number: +49 30 21960284, email: info@kaffeekirsche.berlin) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of the revocation

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (excluding any additional costs incurred if you chose a delivery method other than our cheapest standard delivery option), without undue delay and no later than fourteen days from the day on which we received your notification of withdrawal. For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You are only liable for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing their condition, properties and functionality.

EXCLUSION OR PREMATURE EXPIRY OF THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply to contracts

– for the supply of goods that are not prefabricated and for whose production an individual selection or specification by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;

– for the supply of goods that can spoil quickly or whose expiration date would be quickly exceeded;

– for the supply of alcoholic beverages, the price of which was agreed upon at the time of conclusion of the contract, but which can be delivered no earlier than 30 days after conclusion of the contract and whose current value depends on fluctuations in the market over which the entrepreneur has no influence;

– for the delivery of newspapers, magazines or illustrated magazines, with the exception of subscription contracts.

The right of withdrawal expires prematurely in the case of contracts

– for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons if their seal has been removed after delivery;

– for the supply of goods if, after delivery, they have become inseparably mixed with other goods due to their nature;

for the supply of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery.

RETURNS

The procedures mentioned in this section “Returns” are not a prerequisite for the effective exercise of the right of withdrawal in accordance with the section “Information on the right of withdrawal for consumers”.

Customers are asked to notify the seller of their return before sending it back (Tel.: 030/21960284, E-Mail: info@kaffeekirsche.berlin or via the contact page) to announce the return. This allows the seller to process the return as quickly as possible.

Customers are requested to return the goods to the seller as a prepaid package and to retain the proof of postage. The seller will reimburse the customer for postage costs in advance upon request, provided these costs are not to be borne by the buyer.

Customers are asked to avoid damaging or soiling the goods. If possible, the goods should be returned to the seller in their original packaging with all accessories. If the original packaging is no longer available, other suitable packaging should be used to ensure adequate protection against damage during transport and to avoid any claims for damages due to inadequate packaging.
